  • User: Any individual who accesses and/or uses our Website and Services including, without limitation, current or potential clients and customers and visitors (herein referred to as “you” or “your”).
  • Visitor: Any individual who visits the Company offices or otherwise engages with us at our events or in connection with our marketing or recruitment activities.

  • Troubleshooting and support data you share with us to resolve queries and issues

Please note: When sharing personal information and communicating with us (whether through the Website, text, email, phone, or other means), please refrain from sending us sensitive or private information pertaining to yourself and others. We do not intend to collect or store sensitive information or special categories of information.

If you submit personal information about others, you represent and warrant that you are authorized to do so, that you have received authorization from the person for whom you are providing information, and that the person has consented to have all information used, disclosed, and transferred in accordance with this Policy.

4. CHILDREN UNDER THE AGE OF 18

Our Website is intended for users aged 18 and older. We do not knowingly collect personal information from children under 18. IF YOU ARE UNDER 18, YOU MUST REFRAIN FROM PROVIDING ANY PERSONAL INFORMATION TO US VIA THIS WEBSITE, EMAIL, OR POST MAIL INCLUDING, WITHOUT LIMITATION, YOUR NAME, ADDRESS, TELEPHONE NUMBER, EMAIL ADDRESS, OR ANY SCREEN NAME OR USERNAME YOU MAY USE. 

If you believe a minor has provided us with personal information without parental or guardian consent, the parent or guardian should contact us immediately at legal@ALCEMIS.com to remove the information and unsubscribe the minor. If we learn we have collected or received personal information from a child under 18 without verification of parental or guardian consent, we will promptly delete that information.

This information may be disclosed to (i) our designated service providers, (ii) our partners, (iii) our affiliates, (iv) the party authorizing use of our Services, such as an employer, (v) third-party providers (e.g., data analytics, social media networks, advertising networks), (vi) third-party providers that support ALCEMIS operations, (vii) third-party entities necessary to enforce our Terms and Conditions or any other agreement between you and the Company, (viii) third-party entities, as required by law, to comply with a rule, regulation, or law, or in response to a subpoena, court order, or other legal process, and (ix) any buyer or successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or sale or transfer of some or all of our assets in which your personal information held by us is among the assets being sold or transferred.

As a general rule, we do not sell, rent, or lease voluntarily submitted personal information to third parties. From time-to-time, we may use the information you provide to us to make you offers to purchase services provided by third parties in exchange for a commission or referral fee to be paid to us by said third parties. Should you opt to take part in such promotions, the third party will receive your information, which is governed by the third party’s terms of use and privacy policies.

IF YOU CHOOSE TO PARTICIPATE IN AND DISCLOSE INFORMATION IN GROUP OR PUBLIC AREAS OF THIS WEBSITE, THROUGH SOCIAL MEDIA PLATFORMS CONNECTED WITH ALCEMIS, OR THIRD-PARTY WEBSITES, YOU ACKNOWLEDGE THAT YOUR DISCLOSURE IS VOLUNTARY AND THAT OTHERS MAY SEE OR USE IT. ALCEMIS is not responsible for the information that you or others choose to disclose on this Website, on social media platforms connected with ALCEMIS, or on third-party websites, and neither our nor others’ use of such information is subject to this Policy. 

At any time, you may instruct us to refrain from using or disclosing the personal information we have collected about you to provide you with offers and promotions by contacting us at legal@ALCEMIS.com with a “Marketing Opt-Out” request. Please note: If you exercise this choice, you will continue to receive communications concerning your account and any Services or information you have requested and/or purchased. Marketing Opt-Out requests may take some time to process, consistent with applicable laws.

6. USE OF EMAIL ADDRESS

Your email address will be collected and retained when you sign up for electronic communications from us including, without limitation, to receive newsletters and downloads, to make a purchase for Services, and in the delivery of requested or purchased Services. If you choose to correspond with us through email, we may retain the content of your email messages together with your email address and our responses. 

We are committed to keeping your email address confidential and will maintain your email information in accordance with applicable federal law.

For users from outside the European Union who opt to receive free resources, participate in free training programs, register for a webinar, live event, or seminar, or purchase any Services sold by the Company on this Website, we may automatically enroll ?you to receive our free newsletter. You can opt out via the unsubscribe link at any time.

For users within the European Union who opt to receive free resources, participate in free training programs, register for a webinar, live event, or seminar, or purchase any Services sold by the Company on this Website, we will only enroll ?you to receive our free email newsletter if you affirm consent to it. You can opt out via the unsubscribe link at any time.

In compliance with the CAN-SPAM Act, all emails sent from our Company will clearly state who the email is from and provide clear information on how to contact the sender. Email messages based on our subscription mailing list will also contain concise information on how to remove yourself from our mailing list so that you receive no list-based communication from us.

USERS WHO NO LONGER WISH TO RECEIVE OUR ELECTRONIC NEWSLETTER, PROMOTIONAL MATERIALS, OR UPDATES MAY OPT-OUT OF RECEIVING THESE COMMUNICATIONS BY CLICKING ON THE UNSUBSCRIBE LINK IN A RECEIVED EMAIL. ALCEMIS DOES NOT CONTROL, AND IS NOT RESPONSIBLE FOR, HOW THESE THIRD PARTIES COLLECT, USE, AND DISCLOSE YOUR INFORMATION FOR THEIR BUSINESS PURPOSES OR HOW THEY COLLECT, USE, AND DISCLOSE YOUR INFORMATION TO SERVE INTEREST-BASED ADVERTISEMENTS.

Collection, use, and disclosure of your information by any third-party provider, entity, website, or app is the responsibility of each specific third party and is governed by the third party’s terms of use and privacy policies. Third parties may provide you with choices to opt out of having your information collected or used in a particular way. You are encouraged to read and understand third-party policies, including how you can opt out and/or set cookie preferences.

9. COOKIE AND TRACKING MANAGEMENT

Most browsers accept cookies by default, but you can take manual action to alert you to when cookies are being sent to your devices and to disable cookies. However, if you delete or disable certain cookies or refuse to accept a request to place a cookie, it is possible that some parts of our Website and other websites will function improperly and reduce your user experience.

WE STRONGLY URGE YOU TO TAKE DIGITAL SAFETY PRECAUTIONS TO PROTECT YOUR PRIVACY INCLUDING, WITHOUT LIMITATION, USE A SECURE INTERNET CONNECTION, USE STRONG ACCOUNT PASSWORDS UNIQUE TO EACH WEBSITE OR APPLICATION YOU USE, AND REFRAIN FROM SHARING YOUR PASSWORDS WITH OTHERS.

To protect your privacy, we will employ security measures to ensure that you are the one making the request. This may include requiring you to provide us with the Services you’ve requested or purchased from us in the past, your state and country of residence, and contact information. Depending upon your request, we may ask for additional information.

Email Opt-Out Requests:

  • Users who no longer wish to receive our electronic newsletter, promotional materials, or updates may opt out of receiving these communications by clicking on the unsubscribe link in the email they receive from us. 
  • If you wish to opt out of all email communications, please contact us at legal@ALCEMIS.com with your request. Please note: If you exercise the choice to opt out of all email communications, you will no longer receive email communications concerning your account and any Services or information you have requested and/or purchased. Services requiring email to support delivery may no longer be available. 

Selling Opt-Out Requests: As a general rule, we do not sell, rent, or lease voluntarily submitted personal information to third parties. From time-to-time, we may use the information you provide to us to make you offers to purchase services provided by third parties in exchange for a commission or referral fee to be paid to us by said third parties. In some states, certain privacy laws may consider this “selling”. Residents in some states, such as California and Virginia, have the right to opt out of having their personal information sold. If your state allows you to opt out from this “selling,” and you wish to exercise your opt-out right, contact us at legal@ALCEMIS.com with the subject line “Opt-Out of Sell/Share”. ALCEMIS will not discriminate against you for exercising this right.

ALCEMIS will make reasonable efforts to accommodate privacy rights request. It may take some time to process your request, consistent with applicable law. Please note: Certain laws and regulatory requirements may allow or require us to refuse to provide or delete some or all of the personal information we maintain, in particular if doing so violates any law or legal requirement or causes the information to be incorrect.

Privacy Rights Complaints: If you believe we have infringed or violated your privacy rights, please contact us as required by the ALCEMIS Terms and Conditions regarding the dispute resolution process.

12. TRANSFER OF YOUR PERSONAL INFORMATION TO OTHER COUNTRIES

ALCEMIS controls and operates our online and mobile resources from within the United States of America (“USA”). If you access and use our Website and Services, your personal information may be accessed or transferred both inside and outside of the USA. Countries other than the USA may have different data privacy laws and levels of privacy protection than the USA or your country of residence. By using our Website and Services, you acknowledge and agree to such transfers, including in and to the USA. We rely on appropriate safeguards for such data transfers as permitted under various applicable laws and standards. YOU SHOULD IMMEDIATELY CEASE ACCESS AND USE OF THE ALCEMIS WEBSITE AND SERVICES IF YOU DO NOT WANT YOUR INFORMATION TRANSFERRED TO, PROCESSED, ACCESSED, OR MAINTAINED IN OR OUTSIDE OF THE USA.

13. CALIFORNIA: PRIVACY ACT AND RIGHTS

This section applies to California residents only and is used to fulfill our California Consumer Privacy Act (“CCPA”) obligations and explain your CCPA rights. For purposes of this section, the words “you” and “your” mean only such California residents.

Pursuant to the CCPA, ALCEMIS has not collected, disclosed, shared, or sold any personal information from residents of California in the last twelve (12) months. 

You are requested to review this full Policy to understand the categories of personal information that we may collect in the coming twelve (12) months, the purposes for that information, the sources from which we collect it, and the third parties with whom we may share the personal information. 

California residents have the following rights in relation to their personal information, subject to certain exceptions. You can exercise these rights up to two different times every 12 months.

  • Right to know what personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the purposes for collecting, selling, or sharing personal information, the categories of third parties to whom the business discloses personal information, and the specific pieces of personal information we have collected about you.
  • Right to delete personal information that we have collected from you.
  • Right to correct inaccurate personal information that we maintain about you.
  • Right to opt out of the sale or sharing of personal information if we sell or share your personal information.
  • Right against discriminatory treatment for the exercise of privacy rights conferred by the CCPA, including an employee’s, applicant’s, or independent contractor’s right not to be retaliated against for the exercise of their CCPA rights. We will not discriminate against you for exercising your right to know, delete, correct, or opt out of sales.

  • Right to know: Use “CCPA Right to Know Request” in the subject line. Include details about the information you’d like to know so we can research and reply to your request. 
  • Right to delete: Use “CCPA Right to Delete Request” in the subject line. Include details about the information you’d like to delete so we can research and reply to your request. 
  • Right to correct: Use “CCPA Right to Correct Request” in the subject line. Include details about the information you’d like to correct so we can research and reply to your request. 
  • Right to opt out of the sale or sharing of personal information: 
    • To exercise your opt-out right with ALCEMIS, use “CCPA Right to Opt-Out of Sell/Share” in the subject line. Include details so we can research and reply to your request.
    • To exercise your opt-out rights with third parties, you must follow the policies and procedures set forth by the third parties. You may also use information in the following sections regarding cookies and browser settings: 7. Use of Cookies and Tracking Technologies, 8. Third-Party Collection, Use, and Disclosure of Non-Personal and Personal Information, and 9. Cookie and Tracking Management.

Use of an authorized agent to submit a request: Only you or an authorized agent can make a request about your personal information. When you use an authorized agent to make a request on your behalf, we will require written proof that the agent has been authorized to act on your behalf. We may also require you to verify your identity with us before we research and reply to the request.

To protect your privacy, we may ask you to complete a request form to verify your identity or your authority to make the request. This may include requiring you to provide us with the Services you’ve requested or purchased from us in the past, your state and country of residence, and contact information. YOU MUST INCLUDE YOUR FULL NAME AND A VALID WORKING EMAIL ADDRESS WHEN SUBMITTING YOUR REQUEST SO THAT WE MAY FOLLOW UP WITH YOU REGARDING YOUR REQUEST. A valid phone number would be appreciated but is not required to submit your request. Depending upon your request, we may ask for additional information.

The CCPA only allows us to act on your request if we can verify your identity or your authority to make the request. For requests to know, correct, or delete, if we cannot verify the identity of the requestor pursuant to the regulations set forth in CCPA Article 5, we may deny the request. We shall inform the requestor that their identity cannot be verified.

If you make a verifiable request per the above, we will confirm our receipt and respond in the time frames prescribed by the CCPA.

For any denial, we will explain the basis for the denial, including any conflict with federal or state law, exception to the CCPA, inadequacy in the required documentation, or contention that compliance proves impossible or involves disproportionate effort.

14. GDPR NOTICE

This section only applies to residents of the European Union (“EU”), European Economic Area (“EEA”), UK, and Switzerland and is used to fulfill our General Data Protection Regulations (“GDPR”) obligations and explain your GDPR rights. For purposes of this section, the words “you” and “your” mean only such EU/EEA, UK, and Swiss residents.

If you make a request, we will respond to you within one (1) month of receipt of your request. In the event that we refuse a request under rights of access, we will provide you a reason as to why.

For your protection, we may need to verify your identity before responding to your request. This may include requiring you to provide us with the Services you’ve requested or purchased from us in the past, your country of residence, and contact information. YOU MUST INCLUDE YOUR FULL NAME AND A VALID WORKING EMAIL ADDRESS WHEN SUBMITTING YOUR REQUEST SO THAT WE MAY FOLLOW UP WITH YOU REGARDING YOUR REQUEST. Depending upon your request, we may ask for additional information.

Our third-party newsletter and email marketing vendor, Kit, has audited all of their processes to make sure they are compliant with GDPR and UK GDPR regulations. Kit may use the following to transfer personal data from the EU/EEA, UK, and Switzerland to the United States and elsewhere:

  • The EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF); or
  • The Standard Contractual Clauses (SCCs) approved by the European Commission or the International Data Transfer Agreement (IDTA) issued by the UK Information Commissioner.

Kit complies with all data subject rights of individuals in the EU/EEA, UK, and Switzerland including the right to be forgotten and access requests. Kit’s services allow ALCEMIS to:

  • Delete your personal information from the ALCEMIS subscriber list any time, at your request, or Kit may honor a direct request from you to be removed from the ALCEMIS list. 
  • Access and update your personal subscription data any time.

Kit automatically provides an unsubscribe link at the bottom of each email sent from Kit, allowing you to opt out any time. 

We will retain any information you choose to provide to us until the earlier of (i) you asking us to delete the information, (ii) our decision to cease using our existing data providers, or (iii) the Company decides that the value in retaining the data is outweighed by the costs of retaining it.

The right to lodge a complaint – If you believe your rights under the GDPR have been violated and unresolved, the GDPR gives you the right to file a complaint with a supervisory authority having jurisdiction for your issues.
